HEART Program by AHP
The following Terms and Conditions govern the use of the HEART by AHP website ("Site"), owned by the Associação de Hotelaria de Portugal ("AHP"), headquartered at Avenida Duque de Ávila, 75, 1st Floor, 1000-139, Lisbon.
Using the Site implies full acceptance of these Terms and Conditions. If you disagree with them, please refrain from using the Site. AHP also recommends reading the Privacy Policy, which complements these Terms and Conditions.
Service Description
The Site provides information about the HOSPES Program by AHP and related topics within the hospitality sector.
Personal Data
If you submit personal data on the Site, AHP commits to processing it in compliance with applicable data protection and privacy laws. Collected data will also support an email marketing service, used exclusively for providing additional information about projects and tips, without spamming or sharing irrelevant campaigns. AHP is not responsible for any defect, malfunction, or incompatibility, particularly with user hardware, and is not obligated to provide support for the use of the Site or to guarantee that it meets the user's intended purposes.
AHP reserves the right to add, remove, or modify any content on the Site at any time.
AHP assumes no responsibility for consequences arising from users' access to third-party sites, including those linked to from the Site.
Modifications to the Terms of Service
To always provide the most suitable service, AHP may modify these Terms and Conditions without prior notice.
Use of the services after these changes implies acceptance of the privacy policy and any future updates.
User Responsibility
The user is solely and exclusively responsible for their use of the Site and is required to comply with applicable legislation, including the Copyright and Related Rights Code, the Industrial Property Code, and the Cybercrime Law. The user must act in good faith and ensure their use does not infringe on the rights of others, such as the right to image, good reputation, honor, privacy, or any other rights. The user must also refrain from any actions constituting attacks based on race, nationality, ethnicity, religion, political beliefs, or gender, as well as avoid defamation, incitement to theft, fraud, violence, terrorism, sadism, prostitution, pedophilia, or the use of obscene, indecent, or pornographic content.
The user is authorized to use the Site's content solely for its intended purposes. It is expressly prohibited to reproduce, publish, publicly distribute, or otherwise make the content accessible to third parties for public communication or commercialization. The user is also prohibited from modifying the content without prior authorization from AHP.
The user must not invade the privacy of other Site users and agrees not to send unsolicited messages, collect, process, or share personal data without the owner's consent, or send false or misleading messages that violate any applicable legal standards.
The user is solely responsible for any direct or indirect damage caused to themselves, AHP, or third parties due to their use of the Site. The user agrees to compensate for any damage, actions, claims, or liabilities arising from their actions.
Property Rights
The user acknowledges that the content, including but not limited to text, software, music, sound, photographs, video, illustrations, and other materials found in published articles or commercially produced information presented to the user via the Site's services, including open-source files, is protected under general law and national and international legislation regarding copyright and intellectual or industrial property rights. Users are prohibited from copying, reproducing, distributing, or creating derivative works based on the Site's content without explicit authorization from AHP.
Applicable Law and Jurisdiction
The terms of access and use of the Site, as well as all matters not expressly regulated by these Terms and Conditions, are governed by Portuguese law.
AHP and the user agree that negotiation is the preferred means to resolve doubts, disputes, or conflicts of any nature regarding validity, effectiveness, interpretation, integration, application, or compliance with these Terms and Conditions. However, should negotiation fail, both parties agree that the Lisbon District Court has exclusive jurisdiction to resolve disputes arising from the use of this site, with an explicit waiver of any other jurisdiction.
